Eat Just, Inc. and its subsidiaries (“Eat Just,” “we,” “our,” or “us”) provides this Privacy Notice to describe how we may collect, protect, use, process and share information gathered about you through www.ju.st and https://goodmeat.co/, as well as through events, mobile messaging services, direct marketing campaigns, sweepstakes and competitions, and our branded pages on third party platforms (e.g., social networking services), mobile applications, and applications accessed or used through such websites or third party platforms which are operated by us or on our behalf (the “Sites”). If you use the Sites you explicitly agree to the terms and conditions of the Privacy Notice in effect at the time of your use.

This Privacy Policy explains what information may be collected by or on behalf of Eat Just, how such information may be used and/or shared with others, how we safeguard it and how you may access and control its use in connection with our marketing communications and business activities. As used in this Privacy Notice, the term “Personal Data” means information that identifies an individual, household, or place of business directly or indirectly, by reference to identifier(s) such as name, identification number, location data, online identifier or one or more factors specific to an individual’s physical, physiological, genetic, mental, economic, cultural, educational, commercial, professional or social identity.

Personal Data Collection

We collect Personal Data about individuals as described in this section. If you do not agree with the collection of this Personal Data, you should not use the Sites.

Personal Data Knowingly and Willingly Provided. We collect information that individuals knowingly and voluntarily provide when using our Sites (such as through web forms, user generated content, and contest entries). When using our Sites, you may voluntarily provide information about yourself including your name and contact information.  We offer you the ability to post content that other users can read (e.g., comments, recipe and reviews). Anyone can read, collect and use any Personal Data that accompanies your content. See “Our Right to Use Your Content” in our Terms of Use for more information about user generated content. We do not have to publish any of your content. If the law requires us to take down, remove or edit your Personal Data, we will comply to the required extent. We may also collect other information that you provide when you communicate with us. We will retain the information you submit to us to respond to your inquiry and process your requests. You also agree that we may use any information that you provide for our general purposes, and may share it with our affiliates and third parties, only as described in this Privacy Notice. If you provide us with a telephone number and/or email address, you expressly agree that we, or our authorized agents, can use that number and/or email address to contact you about Eat Just and its associated activities. We may keep any information that you provide us indefinitely.

Personal Data Collected from Third Parties. Our Sites include the ability for you and other users to apply for career opportunities with us and import a resume through www.paycomonline.net. As a result, we receive information about you to consider your application. We may also receive information about you from third parties, including commercial data services, and combine it with information you have provided to us. We may keep all of this information indefinitely.

Site Use Information and Use of Cookies. We may also gather technical information including, but not limited to, browser type, IP address, pages visited and other activities on the Sites, device type, and time and date of visit.  We may also receive information about your current location if permitted by your browser settings.

Like most websites, we employ “cookies” or similar technologies on certain pages of our Sites. Cookies make the use of the Sites easier by, among other things, saving your preferences. We may allow selected third parties to place cookies through the Site to provide us with better insights into the use of the Site or user demographics or to provide relevant advertising to you. These third parties may collect information about a consumer’s online activities over time and across different websites when he or she uses our website. Personal Data Use

We use your Personal Data according to the terms of the Privacy Notice in effect at the time of our use. We may use the Personal Data we collect from you to fulfill your requests and manage the Sites.

We will process your Personal Data where (1) you have provided your consent which can be withdrawn at any time, (2) where the processing is necessary for the performance of a contract to which you are a party, (3) where we are required by law, (4) where processing is required to protect your vital interests or those of another person, or (5) where the processing is necessary for the purposes of our legitimate commercial interests, except where such interest are overridden by your rights and interests.

We may use the Personal Data you give us for our legitimate commercial interests including, among other things:

  • to respond to your inquiries and to provide you with the information, products and services that you request from us;

  • to send you communications about (1) our own products and services, (2) products and services offered by sellers or advertisers on our Sited and (3) products and services of third parties (those not offered by sellers on our Sites) that we think you may find of interest, provided you have given your consent;

  • where the processing is required in order to enforce or apply our Terms & Conditions and other agreements you have entered into with us;

  • to contact you as necessary; and

  • if you provide us information to participate in a sweepstakes or promotion, we will use that information for your participation.

We may use the Personal Data we collect in either an identifiable or an anonymized form (independent of any personal identifiers):

  • to administer the Sites and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

  • to improve the Sites and to customize the content you see on the Sites;

  • as part of our efforts to keep the Sites safe and secure;

  • to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you; and

  • to do internal research on our Sites visitors’ interests and behaviors to better understand and serve our customers.

If we have collected information through the Sites that identifies you individually, we may share this Personal Data with other parties including:

  • Pursuant to a subpoena, court order, governmental inquiry, or other legal process or as otherwise required by law, or to protect our rights or the rights of third parties; or

  • With your consent or as otherwise disclosed at the time of data collection or sharing.

We may aggregate, combine, anonymize and/or pseudonymize any data that we collect and process, including Personal Data. We may share information that has been de-identified or aggregated, or any other technical information, without limitation.

Sharing of Information by you. The Sites offer many ways to find, enjoy, and share content. Your activity on the Sites such as filling out surveys and reviewing and rating products, or otherwise interacting with the Sites may be publicly available.

Third-Party Links

The Sites may provide links to third-party websites or apps, including to apply for Eat Just career opportunities.  We do not control the privacy practices of those websites or apps, and they are not covered by this Privacy Notice.  You should review the privacy notices of other websites or apps that you use to learn about their data practices.

The Sites may also link to social networking websites or include integrated social media tools or “plug-ins,” such as social networking, photo sharing, and video streaming tools offered by third parties. If you use these tools to share personal information or you otherwise share information about our Sites on these social networking websites, those social media companies may collect information about you and may use and share such information, including with us and the general public. We may keep all of this information indefinitely. Your interactions with third-party social networking companies and the use of their features are governed by the privacy policies of the social networking companies that provide those features.  We encourage you to carefully read the privacy policies of any social media accounts you create and use.

Do Not Track Policy

We do not respond to web browser “do not track” signals on our Sites. As such, your navigation of our Sites may be tracked as part of the gathering of quantitative user information described in this Privacy Notice. If you arrive at our Sites by way of a link from a third party site that does respond to “do not track” requests, the recognition of any “do not track” request you have initiated will end as soon as you reach our Sites.

Digital Advertising & Analytics

We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on our behalf and others on non-affiliated platforms.  Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Sites and other sites or apps over time, including information about relationships among different browsers and devices.  This type of advertising is known as interest-based advertising.

Eat Just adheres to the Digital Advertising Alliance ("DAA") Self-Regulatory Principles in connection with this interest-based advertising activity.  You may visit www.aboutads.info to learn more about this type of advertising and how to opt-out of this advertising on websites by companies participating in the Digital Advertising Alliance (“DAA”) self-regulatory program.  If you delete your cookies or use a different browser or mobile device, you may need to renew your opt-out choices exercised through the DAA tool.  Note that electing to opt-out will not stop advertising from appearing in your browser or applications.  It may make the ads you see less relevant to your interests.  Additionally, your browser may offer tools to limit the use of cookies or to delete cookies; however, if you use these tools, our Sites may not function as intended.

Your Choices

If you have subscribed to or are otherwise receiving Eat Just newsletters or similar information from us by email and no longer want to receive such information in the future, you may opt out of receiving certain types of emails by clicking the “unsubscribe” link at the bottom of those emails you receive. Please allow ample time for us to process your request. If you are having difficulty unsubscribing, please contact us as set forth below. You can choose to delete or block cookies by setting your browser to either reject all cookies or to allow cookies only from selected sites. If you block cookies performance of the Site may be impaired and certain features may not function at all.

You can choose to opt out of certain advertisements. Your California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits individuals with whom we have a business relationship who are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. No more than once per calendar year, you may request that we send you via mail or email: (1) the categories of personal information disclosed to those third parties; and (2) the names and addresses of those third parties.  To make such a request, please e-mail us at wecare@ju.st and provide sufficient information for us to determine if this applies to you, attest to the fact that you are a California resident and provide a current California address for our response. Any such request must include "Shine the Light California Privacy Rights Request" in the first line of the description and include your name, street address, city, state, and ZIP code.

Notice to California Residents

The California Consumer Privacy Act of 2018 (“CCPA”) provides several rights to California residents with regards to the collection, disclosure, sale, and deletion of their Personal Data. Our Privacy Notice for California Residents describes in more detail our compliance with CCPA and how residents of California may exercise their CCPA Rights. Notice to Nevada Residents

We do not transfer personal information for monetary consideration. If in the future our approach to transferring personal information changes and you would like to tell us not to sell your information at that time please email us at wecare@ju.st with your name, postal address, telephone number and email address with “Nevada do not sell” in the subject line.

Security

We take the security of Personal Data seriously. We have implemented reasonable technical and organizational measures to protect the confidentiality, security and integrity of your Personal Data. The measures we have implemented take into account the current available security technologies, cost, and risk presented by the type of Personal Data we collect, store, process and use.

Although we use reasonable security measures to help protect Personal Data against unauthorized disclosure or loss, we cannot guarantee the security of Personal Data transmitted to us over the Internet or that information may not be accessed, disclosed, altered or destroyed. You therefore use our Sites at your own risk.

Storage and Retention

The Personal Data that we store is generally stored on our servers located in the United States where laws regarding data protection may be less stringent than the laws in your country. If you are located in another jurisdiction, you should be aware that once your Personal Data is submitted through our Sites, it will be transferred to our servers in the United States. We will retain Personal Data for as long as necessary to fulfill the purpose for which it was collected and to comply with legal requirements.

International Users

We are headquartered in the United States. Personal Data may be accessed by us or transferred to us in the United States or to our affiliates, partners, merchants, or service providers who are located worldwide. If you are visiting our Sites or using our Service from outside United States, be aware that your information may be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated. By using our Sites, you consent to any transfer of this information.

Notice to EU and UK Residents

For individuals within the EEA and the United Kingdom (UK) only. “Personal Information” as used in this section means any information that enables us to identify you either, directly or indirectly. Where Eat Just processes Personal Information about you, such information is controlled by Eat Just, which is headquartered in the United States at 300 Wind River Way, Alameda, California, 94501.

We process your Personal Information for purposes described in this Privacy Notice where we have a legal basis under applicable European and UK data protection law.

We will store your Personal Information, in a form that permits us to identify you, for no longer than is necessary for the purpose for which the Personal Information is processed.

Subject to applicable law, in certain circumstances you may have the right to (a) request access to any Personal Information we hold about you and related information, (b) obtain without undue delay the rectification of any inaccurate Personal Information, (c) request that your Personal Information is deleted provided the Personal Information is not required for our compliance with a legal obligation under European or Member State law or for the establishment, exercise or defense of a legal claim, (d) prevent or restrict processing of your Personal Information, except to the extent processing is required for the establishment, exercise or defense of legal claims; and (e) request transfer of your Personal Information directly to a third party where this is technically feasible. To make a request please email us at wecare@ju.st and provide your name, address, telephone number and relationship to our company. We will verify your identity before responding for your security. We will generally ask for your consent in line with the applicable law before sending you direct marketing communications related to third party products and services. You can choose to stop receiving direct marketing communications from us at any time by following the “Unsubscribe” link at the bottom of any promotional email.

Where you believe that we have not complied with our obligations under this Privacy Notice or European or United Kingdom law, we ask that you contact us first to see if we can resolve the issue. However, you may have the right to lodge a complaint with an EU or UK Data Protection Authority, such as the UK Information Commissioner’s Office.

Child Privacy

If you are under the age of 18, please do not use or access the Sites. It is not our intention to collect Personal Data from anyone under 18 years of age, and we will not knowingly do so. If we are made aware that we have collected any Personal Information from children under the age of 18, and are asked to delete such information from our databases, we will promptly do so.

Updating Your Information

You may request to review, change, remove or update your information that we hold by emailing us at wecare@ju.st. We will respond to such inquiries within thirty (30) business days.

Governing Law

By choosing to visit our Sites or provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Notice will be governed by the law of California. You also agree to abide by any limitation on damages contained in our Terms and Conditions or other agreement that we have with you.

Changes to Our Privacy Notice

We may occasionally amend this Privacy Notice to reflect Eat Just’s activities and user feedback, and we reserve the right to make changes to this Privacy Notice at any time. The use of your information is subject to the Privacy Notice and Terms and Conditions  in effect at the time of use. The provisions contained in this Privacy Notice supersede all previous notices or policies regarding our privacy practices with respect to our Sites.
